We have extensive experience of acting for clients with professional negligence claims against solicitors, accountants, surveyors and architects, amongst others. These claims, which will almost certainly involve dealing with experienced insurers and their lawyers on the other side, frequently call for a dynamic and pro-active approach to the often difficult issues of (1) proving that the loss claimed was caused by the negligence of the professional, and (2) quantifying that loss.
We have the experience necessary to ensure that these issues are tackled fully and properly at an early stage in order to help our client achieve the maximum from their claims as quickly and as cost efficiently as possible.
Examples of matters in which we have recently successfully represented clients involved in professional negligence disputes include:
- a claim against solicitors in relation to negligent tax advice relating to wealth and tax planning for a wealthy non-UK domicile client. The loss was quantified at many millions of pounds and the claim involved complex tax, limitation and causation issues. The claim was settled entirely successfully.
- a substantial claim against solicitors in relation to the negligent drafting of commercial leases which resulted in a successful settlement following mediation.
- a substantial claim against solicitors in relation to an investment made into a commercial/residential property development and which resulted in a successful settlement immediately before trial.
- a claim against an IFA in relation to mis-selling of investments into an Entreprise Investment Scheme
- a claim against a veterinary practice in relation to negligent treatment of a dairy herd
