A pre-nuptial agreement is a contract reached between two people who intend to marry and wish to regularise and organise the legal position of their assets if they subsequently divorce.
Although pre-nuptial agreements are not currently binding in England and Wales, they may be taken into account by the Court on divorce if drafted correctly and entered into in the right circumstances. Recent case law indicates that Judges are becoming much more inclined to give weight to prenuptial agreements. We can advise you on what such an agreement should include in order to increase the likelihood of it later being upheld by the Court.
